Political relations between Russia and Germany are currently in a difficult phase. Since the imposition of mutual sanctions, this has also had a concrete impact on bilateral business transactions. This is not the only reason why the area of performance disputes and dispute resolution is of considerable importance. The enforcement of German court rulings in Russia is still not assured. Arbitration clauses are therefore particularly important for dispute resolution. Mediation should also be seen as a flanking measure to arbitration. Here the EU project “Go to mediation! may provide ideas on cross-border disputes.

Next to the area of contractual disputes is the complex of investment protection. The recent award of the Permanent Court of Arbitration in The Hague on the Yukos proceedings has received a lot of attention in the press. Even apart from these spectacular proceedings, investment protection is in the spotlight, especially when mutual sanctions are imposed.

Irrespective of the current crisis, a court reform has been implemented in Russia this year in which the previously parallel Supreme Courts for civil and commercial jurisdiction have been merged.

This joint event of the German-Russian Lawyers’ Association and the Hamburg Chamber of Commerce is intended to provide an up-to-date and compact overview of the legal protection options relevant to business. The event will be held partly in English.
